Rules and Regulations

  1. The Promoter

The promoter is: Exodus Travels Limited, registered in England and Wales with company number (01150160) of Origin One, 108 High Street, Crawley, West Sussex, United Kingdom, RH10 1BD.

  1. The competition
    • The title of the competition is Exodus: My7WorldWonders.
  2. How to enter
    • The competition will run from 12:01 on 9th October (the "Opening Date") to 23:59 on 15th December (the "Closing Date") inclusive.
    • All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    • To enter the competition:
      • Entrants are required to enter by visiting the competition webpage at My7WorldWonders.com (the “Competition Webpage”).
      • On the Competition Webpage, the entrant will be asked to create an account by either using their personal profile from Facebook, Twitter, Google or by entering their First Name, Last Name, Email, and creating a separate username and The following information must be included with respect to any profile: first/last name, email address and home address.
      • Once the entrant has created his/her profile, he/she must select seven (7) trips from the options and criteria provided by the Promoter.
      • Internet and phone access is required.
      • All entrants must agree to the competition terms and conditions and then opt-in whether they want or not to receive further communication from the Promoter.
      • No purchase necessary and there is no charge to register for use of the website.
    • The Promoter will not accept:
      • responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      • proof of posting or transmission as proof of receipt of entry to the competition.
    • By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

    • One (1) winner will be selected at random by an independent person, from all eligible entries received before the Closing Date.
  3. Eligibility
    • The competition is only open to all residents in the UK aged 18 years or over, except:
      • employees of the Promoter or its holding or subsidiary companies;
      • employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      • members of the immediate families or households of (a) and (b) above.
    • In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
    • The Promoter will not accept competition entries that are: MACROBUTTON optional
      • automatically generated by computer;
      • completed by third parties or in bulk;
      • illegible, have been altered, reconstructed, forged or tampered with;
      • photocopies and not originals; or
      •  
    • There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    • The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
  4. The prize
    • The prize is as detailed in clause 5.2 and only one is available to be won.
    • The winner will receive a trip for one person to each of the seven (7) destinations which made up their entry (each a “Trip”), and each Trip will be the then current trip that the Promoter is offering to those applicable destinations. The Trip will be to the destination chosen, but the Promoter will determine which Trip is offered.

If a Trip is unavailable, the Promoter may offer a suitable alternative and have no liability to the prize winner for any change. Each Trip shall be on the basis, board and inclusions as stated in the then applicable Trip Notes located on the Promoter’s website or as otherwise informed to the prize winner (altogether the “prize”). The prize does not include travel from your home to the starting point of each Trip or other accommodations, flights or travel insurance or any other item except which is expressly stated as included in the relevant Trip Notes as at the date you book each Trip.

The winner has seven (7) consecutive calendar years from 1 January 2019 through December 31, 2026 to take their Trips at a rate not to exceed one (1) Trip per calendar year. Trips are based upon availability and certain reasonable travel restrictions such as holiday “black-out” dates or other periods as such are applied from time-to-time by the Promoter. Dates of travel are subject to change at Promoter’s sole discretion. The first Trip is available to the confirmed winner on 1 January 2019 and must be used by 31 December 2019.  Each subsequent Trip will be made available to the confirmed winner on January 1st of the following calendar year and must be used by 31st December of that calendar year. If the Trip for a particular calendar year is not used, during that calendar year, then that Trip will be forfeited in its entirety. No Trip or destination may be duplicated. The prize is not transferable, refundable, nor may be sold for cash or other consideration.

  • The winner agrees that at the time of confirming each Trip it shall acknowledge and accept the Promoter’s then prevailing booking terms and conditions (currently found at https://www.exodus.co.uk/about-exodus/exodus-booking-conditions) for the Trip provided to it by the Promoter and such terms and conditions shall apply to the winner’s participation in each Trip. All prize details not stated or specified in these terms and conditions will be determined at Promoter’s sole discretion. Expenses not specifically stated in the prize package outlined above are the sole responsibility of the winner.
  • The prize does not include flights, travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses not specified in the relevant Trip notes prevailing at the time. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).
  • You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the Promoter cannot be changed.
  • Prizes are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute any prize with a prize of equal or greater value.
  • The prize is not negotiable or transferable.
  1. Winners
    • The decision of the Promoter is final and no correspondence or discussion will be entered into. Winner will be chosen on or around 20 December 2018 (the “Announcement Date”) and notified by email.
    • The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
    • The Promoter will send the name and county of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in condition 1 .
  2. Claiming the prize
    • If you are the winner of the prize, you will have 7 of days from the Announcement Date to claim the prize by following the instructions in the email announcing you as the winner.
    • If you do not claim the prize by this date, your claim will become invalid. If the winner is disqualified, then the prize will be forfeited. In either case a new winner will be selected at random by an independent person from all remaining eligible entries and the same provisions of clause 6 and 7 shall apply.
    • The prize may not be claimed by a third party on your behalf.
    • The Promoter does not accept any responsibility if you are not able to take up the prize.
  3. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

  1. Ownership of competition entries and intellectual property rights
    • All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
    • By submitting your competition entry and any accompanying material, you agree to: MACROBUTTON optional
      • assign to the Promoter all your intellectual property rights with full title guarantee; and
      • waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

  • You agree that the Promoter may, but is not required to, make your entry available on its website www.my7worldwonders.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  1. Data protection and publicity

    • If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    • The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    • These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

SPONSOR DETAILS

The sole sponsor of the #My7WorldWonders contest (“Sweepstakes”) is Exodus Travels Canada, Inc. 112 Merton Street, Suite 1, ON, M4S 2Z8 Canada (“Sponsor”).

TERMS

The Sweepstakes begins at 12:01 p.m. Eastern Time (“ET”) on 9th October 2018 and ends at 11:59 p.m. ET on  15th January 2019 (“Sweepstakes Period”). Information in this document forms the official rules ("Official Rules"). By submitting an entry, each entrant (“Entrant”) agrees to the Official Rules and warrants that their entry complies with all requirements set out in the Official Rules.

ELIGIBILITY

The Sweepstakes is open to any person who is: (i) a legal resident of the United States of America (including the District of Columbia, but excluding New York), and 21 years of age; or (ii) a legal resident of Canada (excluding the Province of Quebec) who is of or over the age of majority in the province in which he or she resides. Age and residency requirements must be met at the time of entry into the Sweepstakes.  Persons who are employees of the Sponsor, their respective parent companies, affiliates, subsidiaries, agents and the immediate families (spouse, children, parents and siblings) and/or those living in the same household of such persons at any time before or during this Sweepstakes are not eligible to enter. No purchase necessary to participate. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Math skill test and internet access required.

HOW TO ENTER

No purchase necessary. Internet access and email address required.  To obtain one (1) entry, visit the Sweepstakes webpage at www.My7WorldWonders.com (the “Sweepstakes Webpage”). Limit one (1) entry per person. On the Sweepstakes Webpage, the Entrant will be asked to create an account by either using their personal profile from Facebook, Twitter, Google or by entering their First Name, Last Name, Email, and creating a separate username and password. The following information must be included with respect to any profile: first/last name, email address and home address.  Once the Entrant has created his/her profile, he/she must select seven (7) trips from the options and criteria provided by the Sponsor. Limited to one Entry per person. Internet and phone access is required. All Entrants must agree to the contest rules and regulations, and then opt-in whether they want or not to receive further communication from the Sponsor.

WINNER SELECTION

One (1) prize available to be won consisting of trips for one (1) winner to seven (7) destinations of the winner\’s choosing.. One (1) Entrant will be selected at random by an independent person, from all eligible entries received during the Sweepstakes Period. Entrant will be chosen on or around 16th January 2019 and notified by email. Odds of being selected depend on the number of eligible entries received during the Sweepstakes Period. The selected Entrant will be notified by email to the email address provided in the Entrant\’s entry within seven (7) business days after the Sweepstakes Period. In order to be declared the winner, selected Entrant must:  (i) respond to notification of selection within seven (7) days of first attempt by Sponsor; (ii) if a legal resident of Canada (excluding Quebec), correctly answer a time-limited math skill-testing question without assistance of any kind, to be administered by telephone at a mutually convenient time; (iii) if requested, sign and return to Sponsor, within two (2) business days of it being sent by Sponsor, a written affidavit/declaration of eligibility and release form (including a publicity release), releasing the Promotion Entities from any liability in connection with this Contest or the use, misuse, awarding or possession of any prize (“Release”); and (iv) otherwise comply with these Official Rules. If the Sponsor is unable to confirm the Entrant within seven (7) days of notification being sent, if the Entrant is disqualified, or if the Entrant fails to correctly answer the skill-testing question (if applicable),  the prize will be forfeited and an alternate Entrant will be selected at random by an independent person from all remaining eligible entries. Sponsor may refuse or disqualify any entry if the Entrant concerned (or anyone authorized by the Entrant to deal with their entry) acts in a way towards the Sponsor or its staff that Sponsor reasonably considers to be inappropriate, unlawful or offensive. If the selected Entrant is disqualified, or refuses the prize, the Sponsor reserves the right to select and award the prize to another Entrant through the random selection process described above. The Sponsor reserves the right to check the validity of entries, and proof of identity may be requested by the Sponsor from the winner. The Sponsor will not be liable if the prize does not reach the winner for reasons beyond the Sponsor\’s reasonable control. Prior to and as a condition of receiving the prize, the winner will be required to execute and return any applicable tax documentation.

GRAND PRIZE

There is one (1) prize available to be won consisting of trips for one (1) traveler to each of the seven (7) destinations which made up their entry (each a “Trip”), which Trip will be the then current trip that the Sponsor is offering to those applicable destinations. Approximate retail value of the prize is based on sample trip destinations and ranges from $1,055 USD to $5,000 USD]. Actual value will vary depending on chosen trips. If a selected Trip is unavailable, the Sponsor may offer a suitable alternative at its sole discretion and have no liability to the prize winner for any change. Each Trip shall be on the basis, board and inclusions as stated in the then applicable Trip Notes located on the Sponsor\’s website or as otherwise informed to the prize winner (altogether the “prize”). The prize does not include flights, travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses not specified in the relevant inclusions and exclusions in the Trip notes prevailing at the time. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s). The winner also agrees that at the time of confirming each Trip it shall acknowledge, sign and accept the Sponsor\’s then prevailing booking terms and conditions for the Trip provided to it by the Sponsor and such terms and conditions shall apply to the winner\’s participation in each Trip. DATA PRIVACY; LICENSE

By entering the Sweepstakes, Entrants are providing their personal information to Sponsor.  The personal information collected through this Sweepstakes is subject to Sponsor\’s Privacy Policy [www.exodustravels.com/privacy-policy], incorporated herein and made a part hereof by this reference (and available upon written request). Selected entries and the Entrants\’ names may be published by Sponsor in Sponsor\’s publications or on its website, or in any other medium, at the Sponsor\’s discretion. By entering the Sweepstakes, Entrants grant a royalty free, irrevocable, perpetual, non-exclusive license in the entries to Sponsor, and acknowledge that Sponsor may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially using and exploiting the entries to fullest extent possible and without additional compensation to the Entrant. In addition, Sponsor may use Entrant\’s personal details for the purpose of administering this Sweepstakes in accordance with Sponsor\’s Privacy Policy [www.exodustravels.com/privacy-policy] and applicable data protection legislation. By entering this Sweepstakes, Entrants agree that Sponsor and its business partners may use information to contact the Entrant about products and services. CANADIAN ENTRANTS: By entering this Sweepstakes, Canadian Entrants agree to receive email correspondence from Sponsor (or agents of Sponsor) for the purpose of administering this Sweepstakes and for other purposes to which Canadian Entrants specifically consent.

Display or publication of an entry on Sponsor\’s website does not indicate the Entrant will be selected as a winner. Sponsor will not be required to pay any additional compensation or seek any additional approval in connection with such use or exploitation.

LIMITATION OF LIABILITY

By entering this Sweepstakes, Entrants expressly acknowledge and agree that in no event will Sponsors, or their respective affiliates, officers, directors, employees, representatives, AGENTS, FAMILY members and/or residents of the households of such individuals, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, statutory, or punitive damages.

Without limiting the foregoing, with respect to the Sweepstakes and to the prize, Sponsor makes no warranty of any kind, either express or implied. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Sweepstakes entries or entry forms; or alteration of entries or entry forms.

CONDITIONS

All federal, state/provincial/territorial and local taxes (whether foreign or domestic, and including income, sales, and import taxes), fees and surcharges on prizes are the sole responsibility of the prize winners. The winner is encouraged to seek his or her own tax advice regarding the reporting and payment of taxes associated with the prize. The accuracy of the email address is the responsibility of the Entrant. The Sponsor reserves the right to verify the validity and originality of any entry and/or Entrant (including an Entrant\’s identity and address) and to disqualify any entry that is not in accordance with the Official Rules. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights. Any Entrant who does not meet the requirements may be disqualified in the sole discretion of the Sponsor.

The Sponsor accepts no responsibility for resultant loss or damage to persons or properties as a result of this prize being awarded. The Sponsor reserves the right to modify, suspend, cancel or terminate the Sweepstakes, extend or resume the entry period, or change or withdraw the prize at any time without giving advance notice. If the prize (or part of the prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize that is equal or greater in monetary value and/or specification, unless to do so would be prohibited by law.

GOVERNING LAW

Each Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved in the appropriate court located in, or nearest to, Ontario, Canada; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney\’s fees; and (iv) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Ontario, Canada.

1. Information on eligibility, mechanisms on how to enter, the Prize and the other information in the Schedule forms part of these Terms and Conditions. Participation in the Promotion, by submitting an Entry, is deemed acceptance of these Terms and Conditions.

2. Eligibility: Entry is open to Australian residents aged eighteen (18) years or over ( Entrants), except for the following individuals (who are not eligible to participate in the Promotion):

a. employees of the Promoter or any of its Related Bodies Corporate;

b. employees of agents or suppliers of the Promoter or its Related Bodies Corporate, who are professionally connected with the Promotion or its administration;

c. retailers, suppliers, agencies or any other party related to the Promoter; or

d. immediate family members of any party in clause 2a to c above.

3. How to enter : To enter and be eligible to win the Prize, Entrants must, during the Promotional Period, complete the steps on how to enter the Promotion at www.My7WorldWonders.com (the “Promotion Website”), including but not limited to doing the following:

a. visiting the Promotion Website;

b. once on the Promotion Website, creating an account by either using their personal profile from Facebook, Twitter, Google or by entering their First Name, Last Name, Email, and creating a separate username and password. The following information must be included with respect to any profile:

i. first and last name;

ii. email address; and

iii. residential address;

c. selecting its country of residence;

d. selecting and arranging from the options and criteria provided by the Promoter on the Promoter’s Website to create 7 trips to the 7 wonders of the world. A short personalised video clip (Video) will be generated by the Promoter’s Website to reflect the Entrant’s selections;

e. agree to these Terms and Conditions and select whether or not it would like to receive further communications from the Promoter; and

f. submit the entry.

4. There is no cost involved in entering the Promotion, but internet access is required. Once the Entrant submits a valid entry, it will receive a personalised URL link to its Video. Entrants can elect to share their Video on social media platforms (including Facebook, Twitter Pinterest) or by email, by using the personalised URL link. If another person validly enters the Promotion by visiting the Promotion Website via the personalised URL link, the Entrant will receive a bonus entry in the Promotion. Entrants can receive up to 50 bonus entries.

5. All entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. All entries are final and able to be amended by the Entrant.

6. Multiple entries: Entrants must enter the promotion in their own name and, subject to any bonus entries under clause 4, the Entrant can only submit one entry.

7. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

8. The Promoter is conducting the Promotion in 7 regions of the world:

a. Australia;

b. New Zealand;

c. United Kingdom;

d. United States of America;

e. Canada; and

f. other,

9. These Terms and Conditions relate to the Promotion in Australia only. There will be one winning Entrant in each Region. For the avoidance of doubt there will only be one winning Entrant in Australia.

10. Draw: The Prize will be drawn on the Draw Date at the Promoter’s premises in Australia, as particularised in the Schedule, by the use of a barrel draw.

11. Game of chance and skill: The Promotion may be considered a game of both chance and skill. In creating a Video to submit an entry, pursuant to clause 3, the Entrant may be required to exercise a degree of skill. Skill plays no part in determining the winning Entrant and each valid entry will NOT be individually judged on the basis of the Video it submits. The winning Entrant is the person who is drawn by a random barrel draw in accordance with clause 10. Each entry has an equal chance of winning. The winning Entrant will be confirmed by the Promoter following the Draw (or any Unclaimed Prize Draw).

12. Prize: Subject to the exclusions in clauses 14 to 16, the winning Entrant will receive one trip (“Trip”) per year for one person to each of the seven (7) destinations ( Destination) which made up their Video entry. Each Trip will be a current trip that the Promoter is offering at the relevant time to those applicable Destinations. The Trip will be to the Destination chosen by the Entrant in its Video, but the Promoter will determine what type of Trip is offered (for example culture, walking and trekking, cycling, or responsible wildlife).

13. Subject to the inclusions in the Trip Notes, Trips offered by the Promoter may include breakfasts, accommodation, all tour-related transport (including between the accommodation and the relevant Destination), activities, a tour guide or leader and arrival and departure transfers to and from the accommodation. This clause is intended to provide Entrants with an indication only as to what may be included in each Trip. The Trips forming the Prize will comprise the inclusions in the relevant Trip Notes, as at the date the winning Entrant books the relevant Trip in accordance with clause 15. Any accommodation included in the Prize will be arranged by the Promoter or an agent nominated by the Promoter and will be subject to availability.

14. Unless otherwise specified in the Trip Notes for a relevant Trip, the Prize will NOT include travel (for example, flights) from your place of residence to the starting point of each Trip, accommodation prior to, or after, the relevant Trip, travel insurance or any other item which is not expressly stated as included in the relevant Trip Notes, as at the date the winning Entrant books each Trip in accordance with clause 15 .

15. The winning Entrant has 7 consecutive calendar years from 1 January 2019 to 31 December 2025 to take their Trips but may only take one Trip per calendar year. Trips are contingent on availability and certain reasonable travel restrictions such as holiday “black-out” dates or other periods as such are applied from time to time by the Promoter. Dates of travel are subject to change at Promoter’s sole discretion. The first Trip is available to the winning Entrant on 1 January 2019 and must be used by 31 December 2019. Each subsequent Trip will be made available to the confirmed winner on January 1st of the subsequent calendar years and must be used by 31st December of the relevant calendar years. If the Trip for a particular calendar year is not used, during that calendar year, then that Trip will be forfeited in its entirety. No Trip to a Destination may be use more than once.

16. Entrants are responsible for any and all expenses incurred accessing, claiming and/or using the Prize other than those costs expressly included in the Trip Notes (any information, notes or documents provided by the Promoter to the winning Entrant in relation to a Trip at or around the time it books a Trip).

17. The winning Entrant must take out comprehensive travel insurance in respect of each of the Trips.

18. The Promoter’s decision is final with respect to the winning Entrant. The Prize will be awarded in the name of the winner.

19. Promotional Period: The promotional period commences on the Start Date and concludes on the End Date, as per the Schedule ( Promotional Period).

20. Redemption Period: The Redemption Period, during which the Prize may be claimed commences on the Draw Date and ends 3 months after the Draw Date, being 22 April 2019. The Promoter will make all reasonable attempts to contact the winning Entrant. If the winning Entrant does not claim the Prize within the Redemption Period, the Prize will be deemed to have been forfeited.

21. Entrants consent to the Promoter using their name, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting the Promotor’s business and any services or products provided or offered by the Promoter.

22. Venue: The Draw for the Promotion, as the case may be, will take place at Level 5, 163 Eastern Rd, South Melbourne VIC 3025.

23. Scrutineer: The Draw (and any Unclaimed Prize Draw) will be conducted in the presence of an independent scrutineer.

24. Unclaimed Prize: If the Prize is unclaimed by the winning Entrant during the Redemption Period, an Unclaimed Prize Draw will take place on the first business day after the expiry of the Redemption Period (23 April 2018) at the same time, place and manner as the original Draw, subject to any directions from a regulatory authority.

25. The Promoter may, without the need to seek approval from the relevant regulator in NSW Australia, conduct the Unclaimed Prize Draw 3 months from the original Draw at its premises, as is necessary in order to distribute the Prize, subject to any written directions given under applicable legislation.

26. The winning Entrant of the Unclaimed Prize Draw, if any, will be notified by email and/or telephone within 48 hours of the Unclaimed Prize Draw.

27. Unavailable Prize: If the Prize is unavailable and the Promoter has used all reasonable efforts to arrange the Prize, the Promoter can, in its absolute discretion, reserve the right to substitute the Prize with a prize of equal value and/or specification, subject to any written directions from a regulatory authority, and to the maximum extent permitted by law, the Promoter will have no liability to the winning Entrant for any substation of the Prize.

28. Invalid entries: In the event that a winning Entrant’s entry is deemed or found to be invalid, the Promoter may redraw or decide on another winning entry.

29. Travel: Where travel is awarded as a prize, the components of the Prize must be taken together when offered or are forfeited.

30. Dangerous activity: Where the Prize involves dangerous activity, the winning Entrant acknowledges the inherent risk in such activity and further acknowledges that use of the Prize may result in injury or death. The winning Entrant participates in the activity at their own risk. In claiming and making use of a Prize which involves dangerous activity, the winning Entrant must:

a. attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and/or any Prize supplier as determined by them in their absolute discretion;

b. declare to the Promoter and/or any Prize supplier any health-related issues that may affect his/her safe participation in any part of the Prize and obtain a written clearance from their doctor in this respect;

c. not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the Prize;

d. not be under the influence of any drugs including alcohol;

e. comply with all directions of the Promoter and/or any Prize supplier and relevant officials; and

f. wear all safety and other equipment required.

31. The Promoter and/or any Prize supplier in their absolute discretion:

a. reserve the right to refuse to allow the winning Entrant or their companion(s) (if any) to take part in any or all aspects of the Prize if they reasonably believe the winning Entrant or their companion(s) (if any) represent a safety risk or for any other reason; and

b. may cancel the relevant component of the Prize if the conditions are deemed dangerous.

32. No compensation will be payable if the winning Entrant is unable to use any element of the Prize as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.

33. THE PRIZE IS NOT TRANSFERABLE AND NOT REDEEMABLE FOR CASH.

34. Notification: The winning Entrant (and/or any subsequent winning Entrant, where an Unclaimed Prize Draw is held) will be announced within 48 hours of the end of the Promotional Period. The winning Entrant will be notified by email and/or telephone.

35. Publicity: The winner’s full name, social media handle, username, nickname and/or alias and their address (suburb and city only) will be published on the Promotion Website on the day of the Draw (22 January 2019) and/or on the day of the Unclaimed Prize Draw (23 April 2019) for a period of 28 days after the Draw and/or Unclaimed Prize Draw. The winning Entrant consents to the publication of such information.

36. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are the winning Entrant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting the Promotor’s business and any products manufactured, distributed and/or supplied by the Promoter. The Entrant further agrees that they will participate in all reasonable promotional activities in relation to the promotion as requested by the Promoter and its agents.

37. Liability: Except for any liability that cannot by law be excluded by law, the Promoter (including its respective officers, employees and agents) will not be liable to any Entrant for, and the Entrant indemnifies, waives and releases the Promoter in respect of all liability (including but not limited to all expenses, costs, damages, claims, losses) arising in any way out of or in connection with:

a. any act or omission of the Entrant;

b. any breach of these Terms and Conditions by the Entrant;

c. any of the exclusions listed in clauses 14 to 16;

d. any personal injury or loss;

e. claiming the Prize;

f. use of the Prize in any way;

g. any Entry or Prize claim that is late, lost, altered, damaged, delayed or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or

h. any tax liability incurred by a winning Entrant.

38. Despite anything to the contrary, to the maximum extent permitted by law, the Promoter will not be liable under these Terms and Conditions for any consequential loss including but not limited to loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use (including both real and anticipatory) and/ or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

39. The Promoter accepts no responsibility for late, lost, delayed, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.

40. To the maximum extent permitted by law, as a condition of accepting the Prize, the winner must sign any legal documentation as and in the form reasonably required by the Promoter and/or Prize suppliers, including but not limited to a legal release and indemnity form.

41. Online Entrants: In the event that a dispute arises as to the identity of an Entrant, the entry will be deemed to have been submitted by the authorised account holder of the email address. The authorised account holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation that is responsible for assigning email addresses for the domain associated with the email. The Promoter may ask any Entrant to provide the Promoter with proof that such party is the authorised account holder of the email address associated with the entry.

42. Personal information: The Promoter collects personal information in order to conduct the Promotion and for other purposes as set out in the entry form or page for the Promotion and may, for this purpose, collect, use and disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries including the personal information in them becomes the property of the Promoter.

43. Legal Warning: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotion Website, or the information on the Promotion Website, or to otherwise undermine the legitimate operations of the Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

44. Linked Sites: The promotional platform may contain links to other websites (Linked Sites). The Promoter does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the promotional platform are for the Entrants’ convenience only and the Entrant agrees to access, use and otherwise deal with Linked Sites at their own risk.

45. Social Media: Social media membership pages, applications and use of social media generally is subject to the prevailing terms and conditions of use of the social media platform. Unless otherwise indicated in these Terms and Conditions, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and Pinterest. If an Entrant uses social media to participate in the promotion, the Entrant understands that they are providing their information to the Promoter and not to any social media platform. Entrants are solely responsible and liable for the content of their Entries and any other information they transmit to other Internet users. By participating in the Promotion, the Entrant releases Instagram, Facebook, Twitter, Pinterest or applicable social media site from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associate with the Promotion.

46. General: Unless the contrary intention appears, a reference in these terms or in any advertisement relating to the promotion, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.

47. Force Majeure: If performance of the Promotion, provision or use of the Prize (or any part of it), or any obligation under these Terms and Conditions is prevented, restricted, or interfered with by a Force Majeure, and if as a result the Promoter is unable to carry out its obligations or to provide the Entrant with the Prize, the Promoter can in its absolute discretion, subject to any written directions made under applicable legislation, cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as the original Prize. The Promoter will give public notice of such an event and that the Promotion has been cancelled, terminated, modified or suspended. The term Force Majeure means any event or circumstance beyond the Promoter’s reasonable control includes, without limitation, acts of God, fire, explosion, vandalism, storm or other similar occurrence, orders of acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lock-outs and work stoppages, terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion. The Promoter will use reasonable efforts under the circumstances to avoid or minimise any Force Majeure. An act or omission will be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates.

48. Delivery: The Promoter will deliver the Prize within 14 days of the Draw Date.

49. Amendments: These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority, or as otherwise required by the Promoter and published on the Promotion Website.

50. Jurisdiction: These Terms and Conditions are governed by the laws of the ACT, NSW and South Australia (as applicable) and the Commonwealth of Australia. Entrants submit to the jurisdiction of the courts of the ACT, NSW and South Australia.

51. Entire Agreement: These Terms and Conditions represent the entire agreement between the Promoter and any Entrant (including the winning Entrant) and supersede any prior agreement, understanding or arrangement between the Promoter and any Entrant (including the winning Entrant), whether oral or in writing.

52. Representations: The Promoter excludes all, warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.

1. The Promoter

1.1 The promoter is: Exodus Travels PTY LTD, ABN 61 141 421 525. 163 Eastern Rd, Level 5, South Melbourne 3205.

2. The competition

2.1 The title of the competition is Exodus: My7WorldWonders.

3. How to enter

3.1 The competition will run from 00:01 on 12 November 2018(the " Opening Date") to 23:59 on 15 January 2019 (the " Closing Date") inclusive.

3.2 All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3 To enter the competition:

(a) Entrants are required to enter by visiting the competition webpage at www.My7WorldWonders.com (the “Competition Webpage”).

(b) On the Competition Webpage, the entrant will be asked to create an account by either using their personal profile from Facebook, Twitter, Google or by entering their First Name, Last Name, Email, and creating a separate username and password. The following information must be included with respect to any profile: first/last name, email address and home address.

(c) Once the entrant has created his/her profile, he/she must select seven (7) trips from the options and criteria provided by the Promoter.

(d) Internet and phone access is required.

(e) All entrants must agree to the competition terms and conditions and then opt-in whether they want or not to receive further communication from the Promoter.

(f) No purchase is necessary and there is no charge to register for use of the website.

3.4 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.7 Once you have completed the steps described above in clause 3.3, the Competition Webpage will automatically generate a video depicting the 7 trips you selected (“Video”). Entrants can elect to share their Video on social media platforms (including Facebook, Twitter and Pinterest) or by email, by using the personalised URL link. If another person validly enters the competition by visiting the Competition Webpage via the personalised URL link, the entrant will receive a bonus entry in the competition. Entrants can receive up to 50 bonus entries.

3.8 One (1) winner will be selected at random by an independent person, from all eligible entries received before the Closing Date.

4. Eligibility

4.1 The competition is only open to New Zealand citizens or residents aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

4.4 Subject to clause 3.7 of these terms and conditions, there is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

5. The prize

5.1 The prize is as detailed in clause 5.2 and only one is available to be won.

5.2 The winner will receive a trip for one person to each of the seven (7) destinations which made up their entry (each a “Trip”), and each Trip will be the trip that the Promoter is offering to those applicable destinations at the time that the Trip is booked by the winner. The Trip will be to the destination chosen, but the Promoter will determine which Trip is offered.

5.3 If a Trip is unavailable, the Promoter may offer a suitable alternative and have no liability to the prize winner for any change. Each Trip shall be on the basis, board and inclusions as stated in the then applicable Trip Notes located on the Promoter’s website or as otherwise informed to the prize winner (altogether the “prize”). The prize does not include travel from your home to the starting point of each Trip or other accommodations, flights or travel insurance or any other item except which is expressly stated as included in the relevant Trip Notes as at the date you book each Trip.

5.4 The winner has seven (7) consecutive calendar years from the Announcement Date through December 31, 2026 to take their Trips at a rate not to exceed one (1) Trip per calendar year. Trips are based upon availability and certain reasonable travel restrictions such as holiday “black-out” dates or other periods as such are applied from time-to-time by the Promoter. Dates of travel are subject to change at Promoter’s sole discretion. The first Trip is available to the confirmed winner on the Announcement Date and must be used by 31 December 2019. Each subsequent Trip will be made available to the confirmed winner on January 1st of the following calendar year and must be used by 31st December of that calendar year. If the Trip for a particular calendar year is not used, during that calendar year, then that Trip will be forfeited in its entirety. No Trip or destination may be duplicated. The prize is not transferable, refundable, nor may be sold for cash or other consideration.

5.5 The winner agrees that at the time of confirming each Trip it shall acknowledge and accept the Promoter’s then prevailing booking terms and conditions (currently found at https://www.exodustravels.com/about-exodus/exodus-booking-conditions ) for the Trip provided to it by the Promoter and such terms and conditions shall apply to the winner’s participation in each Trip. All prize details not stated or specified in these terms and conditions will be determined at Promoter’s sole discretion. Expenses not specifically stated in the prize package outlined above are the sole responsibility of the winner.

5.6 Exclusions: The prize does not include flights, travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses not specified in the relevant Trip notes prevailing at the time. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).

5.7 You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the Promoter cannot be changed.

5.8 Prizes are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute any prize with a prize of equal or greater value .

5.9 The prize is not negotiable or transferable.

6. Winners

6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into. Winner will be chosen on or around 17 January 2019 (the “Announcement Date”) and notified by email.

6.2 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

7. Claiming the prize

7.1 If you are the winner of the prize, you will have 7 days from the Announcement Date to claim the prize by following the instructions in the email announcing you as the winner.

7.2 If you do not claim the prize by this date, your claim will become invalid. If the winner is disqualified, then the prize will be forfeited. In either case a new winner will be selected at random by an independent person from all remaining eligible entries and the same provisions of clause 6 and 7 shall apply.

7.3 The prize may not be claimed by a third party on your behalf.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of entering the competition or taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned .

9.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Trade Marks Act 2002, Copyright Act 1994 or Patents Act 2013 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3 You agree that the Promoter may, but is not required to, make your entry available on its website www.my7worldwonders.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

10. Data protection and publicity

10.1 By entering the competition in accordance with these terms and conditions, you are providing your personal information to the Promoter. The Promoter collects your personal information for the purposes of carrying out the competition in accordance with these terms and conditions, for marketing purposes and for any other purposes identified in the Exodus privacy policy https://www.exodustravels.com/privacy-policy . The Promoter may disclose your entry, including your personal information, in accordance with clause 9.3 of these terms and conditions.

10.2 The Promoter will only collect, hold and process your personal information as set out in the Exodus privacy policy.

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

11.3 These terms and conditions shall be governed by New Zealand law, and the parties submit to the exclusive jurisdiction of the courts of New Zealand.
